Terms and Conditions of Sale

Please carefully read these Terms and Conditions before purchasing any Hunter products at us.hunterboots.com (the "Website"). By purchasing Hunter products on the Website, you agree to be bound by these Terms and Conditions of Sale.

1. Your Account

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorized access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorized manner.

Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when you registered.

The Website only sells products to individuals who can purchase with a credit card/debit card. If you are under sixteen (16), you may use the Website only with the express permission and supervision of a parent or guardian.

Hunter reserves the right to refuse access to the Website, terminate accounts, remove or edit content, or cancel orders at its discretion. If we cancel an order, it will be without charge to you.

2. Privacy

Please review our Privacy Policy, which also governs your visit to the Website to understand how Hunter uses your information.

3. Our Contract

When you place an order to purchase a product from the Website, we will send you an email confirming receipt of your order and containing the details of your order (the "Order Confirmation E-mail"). The Order Confirmation Email is acknowledgement that we have received your order and does not confirm acceptance of your offer to buy the product(s) ordered. We only accept your offer, and conclude the contract of sale for a product ordered by you, when we dispatch the product to you and send e-mail confirmation to you that we've shipped the product to you (the "Shipping Confirmation E-mail"). Your contract is with Hunter Boot USA, LLC. Without affecting your right of withdrawal set out in section 5 below, you can cancel your order for a product at no cost any time before we send the Shipping Confirmation E-mail relating to that product. Hunter will retain the title in the products until full payment has been made by you and has been received by Hunter. Hunter reserves the right to hold any orders after the Shipping Confirmation E-mail has been sent out for internal review. In the event that Hunter is unable to supply the products in your order due to stock availability, the order will be canceled and a refund processed.

If you place a pre-order for a product, your order will be confirmed as set out above and payment will be taken upon shipment. Your Order Confirmation Email will advise when you can expect to receive the pre-ordered product. Please note that if you order available products with the pre-ordered product, your entire order will be shipped once the pre-ordered product becomes available.

Hunter reserves the right to hold any orders prior to shipping for security review. Hunter only delivers its products to the locations listed on the Website. We regret that we cannot ship to any place outside the 50 United States. Please see our list of Distributors for details on how to obtain Hunter products in other worldwide countries. In the event that an order is placed for a delivery to a location where we do not deliver, the order will be canceled and a refund processed.

4. Deliveries

We will endeavor to deliver all products you have ordered within the time period specified on your Order Confirmation Email. Please click here to view our delivery details and charges.

All products purchased from the Website are made pursuant to a shipment contract. This means that the risk of loss for such products pass to you upon our delivery to the carrier. If you have received your Shipping Confirmation Email but your products have not arrived within the time specified in the Shipping Confirmation Email, please contact us and we will take all reasonable steps to assist you. Note that during exceptionally busy periods (e.g., Christmas) or when the weather is particularly inclement, please allow an additional day before raising a query.

If your order has not been received within our specified timescales as further set out below, in the first instance please check with your local UPS delivery office to see that they are not holding your parcel. If they confirm that they do not have your products, please contact us and we will do our best to assist.

5. Returns

You can only use the following process to return Hunter products which have been purchased directly through this Website. If you purchased your Hunter products at a retail store or from another websites, the products must be returned to the original store or site from which they were purchased.

If for any reason you are not happy with your Hunter products, please follow our Returns Procedure, so that we can assist you in the exchange or refund of your order. Hunter reserves the right to reject the return of products which are not returned in accordance with our Returns Procedure and we may request that you pay for the shipping of such goods back to you. Our Returns Procedure does not affect your statutory rights.

Occasionally white marks may appear on your boots. This is not a defect, but a release of natural protective wax that can be easily wiped clean with a damp cloth. 6. Returns Procedure

You may return new, unworn or unused products within 30 days of the date the products were shipped to you.

All products must be returned to us unused, in a fully re-salable condition, with all original packaging. We ask that you take care of returned products. If the goods have been used, they will be returned to you, and no credit will be issued. Please ensure that your return package is packed and sealed securely.

In cases of exchanges for an item of lesser value, we will credit the difference back to the original card used for purchase. We will need to receive the returned item back in a sale-able condition for us to initiate the exchange. If you would like to make an exchange for a style of a higher value than the item originally purchased, you must send back the item, following the instructions below, and submit a new order online for the new item. To initiate your return or exchange, please follow the instructions below:

a) Log into your account from the Sign In link located at the top right of our site.

b) Under the Order History section of your account, locate the order number that contains the item(s) that you wish to return or exchange and select Return/Exchange.

c) For each item, select the reason for the return along with whether it is being sent back as a return for refund or exchange. For exchanges, select the new color and/or size that you wish to receive. If you would like to exchange for a different style up to the same price as the original item, please contact our Customer Service team at 877.495.1500 or information@hunterboots.com.

d) If exchanging, confirm the address that you would like to receive your new item at, and submit your request.

e) Print your UPS prepaid return label by clicking on the Return Label link. A copy will also be sent to the email address on file for the account. Attach the label to your shipping box and drop it off at your nearest UPS location.

If you are unable to log into your Hunter account or need any assistance initiating your return/exchange, please contact our Customer Service team at 877.495.1500 or information@hunterboots.com.

Please do not return items to our head office address in New York City. All returns are processed at our warehouse.

Final sale items may not be returned or exchanged.

7. Discrepancies

If there are any discrepancies with your order, you must notify us within seven (7) working days of receipt. If you have been shipped the incorrect goods then please do accept our apologies. Please follow the Returns Procedure as outlined above. Any replacements will be sent to you at no extra cost to yourself.

8. Hunter Boot Warranty

Our handmade rubber boots including the Balmoral collection are guaranteed against manufacturing defects for 12 months from date of purchase. This is not a guarantee against wear and tear, improper fitting/sizing or misuse of our products. In the event that your rubber footwear is defective, please return to your authorized Hunter Stockist with the valid proof of purchase for evaluation. All footwear must be cleaned thoroughly before being returned for evaluation. This does not affect your statutory rights. Because of its unique and lightweight foldable construction, the warranty does not apply to the Original Tour Boot. 8. Feedback and Complaints Policy

We welcome any comments about our service, so that we can improve what we are doing. Our aim is to deal with any problems quickly and fairly. If you have reason to complain about our service, please e-mail our Customer Services Team at information@hunterboots.com, stating clearly that you are making a complaint. Alternatively, call us at 1-877-495-1500 and say that you wish to make a complaint. Our aim is to respond to your complaint within seven (7) working days, either resolving the complaint, or with a timescale for resolution.

9. Pricing and availability

All prices are quoted in USD and are exclusive of any applicable sales tax. All item prices are exclusive of delivery charges. A list of our delivery charges can be found on our shipping information page. We list availability information for products sold by us on the Website, including on each product information page. Beyond what we say on that page or otherwise on the Website, we cannot be more specific about availability. Please note that shipping dates are estimates only. Unless otherwise stated, dispatch dates are not guaranteed and should not be relied upon. As we process your order, we will inform you by email if any products you order are subsequently found to be unavailable. Despite our best efforts, a small number of the products on the Website may be mis-priced. If a product's correct price is lower than our stated price, we will charge the lower amount and send you the product. If a product's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping the products or cancel your order and notify you of such cancellation.

10. Disclaimer and limitation of liability

THIS WEBSITE IS PROVIDED BY HUNTER ON AN "AS IS" AND "AS AVAILABLE" BASIS. HUNTER MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS WEBSITE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THIS WEBSITE. IT IS EXPRESSLY AGREED BY YOU THAT YOUR USE OF THIS WEBSITE IS AT YOUR SOLE RISK. HUNTER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF SALEABILITY AND FITNESS FOR PURPOSE TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW. HUNTER DOES NOT WARRANT THAT THIS WEBSITE, ITS SERVERS, OR E-MAIL BY US ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. 12. Disputes

Any dispute relating in any way to your visit to the Website or to products you purchase through the Website may be submitted to the courts of the Southern District of New York, except that, to the extent you have in any manner violated or threatened to violate Hunter's intellectual property rights, Hunter may seek injunctive or other appropriate relief in any court in any country in the world, and you consent to exclusive jurisdiction of such courts.

13. Alteration of Service or Amendments to the Conditions

We reserve the right to make changes to our Website, policies, and these Terms and Conditions of Sale at any time. Your usage of the Website and your orders will be subject to the policies and Terms and Conditions of Sale in force at the time that you use the Website or that you order products from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of the provisions of these Terms and Conditions of Sale are deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of the remaining conditions.

14. Events beyond our reasonable control

Hunter will not be held responsible for any delay or failure to comply with our obligations under these Terms and Conditions of Sale if the delay or failure arises from any cause that is beyond our reasonable control. This condition does not affect your statutory rights.

15. Waiver

If you breach these Terms and Conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation, or in the same situation at a different time, where you breach these conditions.

16. Governing law and jurisdiction

Your use of the Website, any purchase by you on the Website of any products and these Terms and Conditions of Sale will be governed by and construed in accordance with the laws of the United States and the State of New York and will be deemed to have occurred in England. You agree, as we do, to submit to the non-exclusive jurisdiction of the courts in the Southern District of New York. Your statutory rights are not affected by these Terms and Conditions of Sale.

17. Resale

You may purchase products from the Website for personal use only and not for resale. If you would like to be contacted with regard to becoming an official Hunter stockist, please send your business contact details to Hunter and a member of our sales team will be in contact with you shortly.

18. Color Disclaimer

We have made every effort to accurately represent the colors of the products on the Website. However, as colors vary between monitors and operating systems, we cannot guarantee that the colors that appear on your screen accurately reflect the actual colors of products.

19. Promotions

The promotion code is valid for one order per customer on all Hunter full price collections on us.hunterboots.com. This discount code cannot be used in conjunction with any other promo code or offer. All shipping costs will be charged at the full rate as normal Hunter reserves the right to terminate or change this discount without notice. Offer cannot be redeemed in Hunter Regent Street, London store or Woodbury Commons Outlet store. Offer not valid on hunterboots.com and ca.hunterboots.com.

HUNTER FESTIVAL COMPETITION PRIZE DRAW TERMS AND CONDITIONS

HUNTER BOOT LIMITED ("HUNTER")

The following Terms and Conditions apply to the Hunter Festival Prize Draw (the "Prize Draw"), organized by Hunter Boot Limited. By entering into this Prize Draw participants agree to be bound by the following Terms and Conditions:
1. The promoter of this Prize Draw is Hunter Boot Limited, 17 Connaught Place, London, W2 2ES (the "Promoter").

  1. The Prize Draw opens at 4 am (EST) on Friday, April 1, 2016 (the "Opening Date") and closes at 7 pm (EST) on Saturday, June 4, 2016 (the "Closing Date"). No entries shall be accepted before the Opening Date or after the Closing Date. There is no limit to the number of times participants can enter the Prize Draw. Third party or bulk entries will not be accepted and entries not in accordance with the entry instructions are invalid.

  2. In order to enter the Prize Draw, entrants must enter their full details as directed on the Hunter Competition landing page http://us.hunterboots.com/competition/festival

  3. The Prize Draw is open to anyone 17 or older throughout the world. The Prize Draw is specifically closed to employees of (i) the Promoter, Pentland Brands plc, and any associated companies, and their families and (ii) any other company, organization or person assisting or connected with the promotion.

  4. The Promoter accepts no responsibility for entries that are misdirected, lost, delayed, damaged or corrupted due to any computer malfunction, virus, bug, delay or other reason whatsoever.

  5. This Prize Draw is in no way sponsored, endorsed, administered by or associated with the Promoter.. Furthermore, you understand that you are providing your details to Hunter and not to the Promoter.

  6. NO PURCHASE OF ANY KIND IS NECESSARY TO TAKE PART IN THIS PRIZE DRAW. You do not have to buy any Hunter product in order to enter this Prize Draw.

  7. There will be 1 winner (the "Winner"). The Winner will receive Hunter products from the Hunter Original Festival collection only to the value of $500. (the "Prize"). The Promoter will work with the Winner to select the item in the Prize.

  8. The Promoter's decision is final and no correspondence will be entered into other than to confirm the prize items and the Winner's delivery address. The Promoter will arrange delivery of the Prize.

  9. The Winner agrees not to sell, order to sell or use the Prize for any commercial or promotional purposes (including placing the Prize on an internet auction site).

  10. The Prize may be altered or varied at the Promoter's sole discretion and substituted with a prize, which, in the Promoter's sole opinion, is a suitable alternative. The Promoter shall not be liable for any claims or complaints of any nature in respect of the Prize. The Prize is subject to availability. There are no cash alternatives and the Prize is not negotiable, exchangeable or transferable.

  11. The Winner will be drawn at random and contacted via email on Monday, June 6, 2016. Hunter will email requesting them to email digital@hunterboots.com with their name, email address and phone number. If the Winner cannot be successfully contacted by 12 pm EST on Monday, June 13, 2016, the Promoter reserves the right to select another randomly selected winner from the remaining eligible entries and thereafter until a Winner has been successfully contacted.

  12. The Winner agrees to take part in post-Prize Draw publicity at the request of the Promoter. By entering the Prize Draw, entrants agree to the Promoter's unrestricted use of any post-Prize Draw publicity for the Promoter's own purposes in all activities including, without limitation, marketing and promotional activities worldwide including use on the Promoter's websites and social networking platforms.

  13. The Promoter reserves the right to discard any Entry which it subsequently discovers does not fulfill the Entry criteria.

  14. Information regarding personal data provided in the entry form will be collected, stored and processed in the Hunter database for the purpose of managing entry into this Prize Draw. By entering the competition you are opting in to receive Hunter marketing emails from which you can unsubscribe at any time. Such information will not be used for any other purpose than as stated in these Terms and Conditions or as separately accepted by you.

  15. All information submitted to the Promoter as part of this Prize Draw will be treated in accordance with the Promoter's privacy policy at www.hunter-boot.com and will be held and processed in accordance with the requirements of the 1998 Data Protection Act.

  16. The Promoter reserves the right to amend these Terms and Conditions and/or cancel the Prize Draw at its sole discretion.

  17. To the maximum extent permitted by law, the Promoter and its related entitles shall not be liable for any claims or actions of any kind whatsoever for damages or losses to persons or property which may be sustained in connection with receipt, ownership or use of the Prize.

  18. By entering this Prize Draw entrants agree to be bound by these Terms and Conditions. All entry instructions from part of these Terms and Conditions. English law governs this Prize Draw and each party submits to the exclusive jurisdiction of the English courts.
